In
Mediation, the couple negotiate for themselves guided by a neutral,
trained and certified Mediator with the goal of ensuring the future
well-being of each other and their families. While the Mediator may
give legal information to the participants, she may not give legal advice
to either. When conflicts occur, the Mediator will help them to understand
each others concerns, better enabling them to reach common ground.
Mediation
is a conflict resolution process which does not rely on a court-imposed
resolution. Rather it relies upon an agreement by the divorcing partners
to commit to an atmosphere of honesty, cooperation, integrity and professionalism.
This process assists partners in reaching agreement on all pertinent
issues without opposing lawyers doing battle for them.
It
is important that each party commit to eliminating the negative economic,
social and emotional consequences of protracted litigation to themselves
and their families.
This
process allows divorcing partners to reach their goal with dignity,
in a shared decision-making atmosphere that is healthier for everyone
who is impacted by the complexities of a divorce.
